SwitchLeads LLC operates as a lead marketing platform connecting property lead sources with licensed real estate professionals. We are not a real estate brokerage, settlement service provider, or party to any real estate transaction.
This Privacy Policy applies to SwitchLeads LLC ("We", "Our", "Us"). This Privacy Policy explains how we collect, use, and share the personal information that we gather on our websites and subdomains, or through your use of our products and services, including the SwitchLeads platform and mobile application (together, "Sites"). By continuing to use our Sites, you agree to the terms of this Privacy Policy.
This Privacy Policy solely applies to our information collection, use, and disclosure practices for personal information that we process for our own purposes and means.
Our Privacy Policy does not apply to the practices of any wholesalers, licensed real estate agents or brokers, or other real estate professionals to whom we may act as a processor or service provider. If you are a party to a transaction facilitated through our platform and want to learn more about how a wholesaler or real estate professional processes your personal information, you should contact that respective party directly for their applicable privacy policy.

What Types of Personal Information Do We Collect?
Information You Give Us. You may give us information by signing up for an online account, submitting leads or property information through our platform, entering information through our online forms or surveys, contacting us through our live chat or support service, or contacting us by phone or email for information or customer service.
The categories of information we collect include:
- Contact information, such as name, address, location, email address, and telephone number
- Online identifiers, such as IP address, cookies, username, and password
- Professional, employment, or transaction information, such as your role (wholesaler, licensed real estate agent or broker, or investor), company affiliation, license numbers where applicable, property details associated with submitted leads, and any other information required to verify your qualifications or facilitate a lead referral on our platform
- Financial information, such as payout account details, tax identification numbers (e.g., W-9 information), and transaction history, to the extent necessary to process commissions and payouts upon a retail close
Information We Automatically Collect. Like many website operators, we collect information that your browser sends whenever you visit our Sites.
This includes Log Data, such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Sites that you visit, the time and date of your visit, the time spent on those pages and other statistics, and whether you reached our page via a social media or email campaign. This information may be collected via several technologies, including cookies, web beacons, clear GIFs, canvas fingerprinting, and other means. You can control cookies in your browser to enable or disable them.
Information We Collect From Third Parties. If you access our Sites through third parties (e.g., Facebook or Google), or if you share content from our Sites to a third-party social media service, the third-party service will send us certain information about you if the third-party service and your account settings allow such sharing. The information we receive will depend on the policies and your account settings with the third-party service. We may also receive lead and property information from wholesalers, real estate data providers, or referral partners who submit leads on behalf of property owners or investors.
How Do We Use Personal Information?
We use your personal information as follows:
- To provide you with the services on our platform, which involves receiving and managing real estate leads, marketing those leads to qualified licensed real estate agents and brokers, and tracking transactions through to close
- To calculate, process, and disburse commission payouts to wholesalers and referral partners at the agreed fixed percentage upon a verified retail close
- To facilitate communication between wholesalers, licensed real estate agents and brokers, investors, and other real estate professionals participating in lead referrals on our platform
- To verify the identity and qualifications of platform participants, including wholesalers submitting leads and licensed real estate professionals receiving leads
- To track the status of submitted leads and closings in order to administer our pay-at-close compensation model accurately
- To market our products and/or services to you
- To analyze Sites usage and improve the services offered
- For market research, project planning, and troubleshooting problems
- To provide you with employment opportunities
- For detecting and protecting against error, fraud, or other criminal activity, including the detection of duplicate leads, fraudulent closing claims, or unauthorized use of platform data
How Do We Share Personal Information?
With Transaction Parties, Platform Users, and Partners. We may share your name, professional affiliation, and contact information with other registered platform users as necessary to facilitate a lead referral. For example, if you are a wholesaler who has submitted a lead, we may share your contact information with a licensed real estate agent or broker receiving that lead, and vice versa. We may share your professional information with the public with your consent, such as in testimonials or case studies. You can opt out of non-transactional sharing by customizing your privacy and visibility settings within your account, or by emailing us at [email protected].
Affiliates and Service Providers. We share your information with our third-party service providers and subcontractors as required to offer you our products and services. These service providers may include cloud hosting providers, analytics providers, customer support platforms, payment processors, CRM platforms, and infrastructure vendors that process information solely on our behalf.
Third-Party Links and Websites. Our Sites may contain links to and from the websites of third parties. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any data to these websites.
Disclosures Required by Law. We may be required to disclose your data in response to lawful requests by public authorities, including to meet law enforcement requirements. How Do We Respond to 'Do Not Track' Signals?
Do Not Track ("DNT") is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Some browsers transmit "Do Not Track" (DNT) signals. Because there is no uniform industry standard for interpreting DNT signals, our Sites do not currently respond to DNT settings.

SMS/Text Message Communications. By providing your phone number and opting in to SMS communications, you consent to receive text messages from SwitchLeads LLC. These messages may include lead status updates, payout confirmations, and customer support communications. Message and data rates may apply. Message frequency varies based on account activity. You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. After opting out, you will receive a single confirmation message and no further texts. To re-enroll, reply START or contact us at [email protected]. For help, reply HELP to any message or contact our support team. Opting out of marketing SMS messages will not affect your receipt of transactional messages required to service your account, unless you separately request that we cease all communications.
Third-Party Marketing. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties for the third parties' direct marketing purposes. Nevada Privacy Rights

When determining the retention period, we take into account various criteria, such as the type of services provided, the nature and length of our relationship with you, the status of submitted leads and closed transactions, mandatory retention periods provided by law, and the applicable statute of limitations.
Data Breach Notification
In the event of a data breach that compromises the security, confidentiality, or integrity of your personal information, SwitchLeads LLC will notify affected users in accordance with applicable state and federal law. Where required, we will provide notice without unreasonable delay and, in most cases, within 30 to 60 days of discovering the breach, depending on the requirements of your state of residence. Notification may be provided via email to the address associated with your account, written notice, or, where permitted by law, through a prominent notice on our Sites. Notice will include a description of the nature of the breach, the categories of information involved, steps we are taking to address the breach, and recommended steps you may take to protect yourself.
